An informal approach would be a start. However, if this does not work then discuss firstly with a colleague then your supervisor. You are protected by the Sex Discrimination Act 1984 because your colleague’s actions are “unwelcome”. Your employer is obliged to take action to remedy the situation. A large workplace may have a grievance officer. If this fails then you could go to your union. The next step would be to contact the Anti-Discrimination Board (ADB) and finally if all else fails, complain to the police if you have been physically assaulted. This, as yet, has not happened in the scenario!

There may be a number of reasons why Joe was promoted ahead of you. However, this case does seem to need further investigation. The Affirmative Action (EEO) Act 1986 may have been breached. It could be an example of indirect discrimination also so could be covered under the anti-discrimination laws.
